Terms of Use and Sale

1. Who we are

Aparté is a dating service published by [TO BE COMPLETED: company name, legal form, share capital, registered office address, SIREN number, RCS registration, intra-community VAT number]. You can write to us at [TO BE COMPLETED: contact email address] or from within the app ("Me" tab).

These terms (the "Terms") govern the use of the Aparté app and the sale of the subscription. By creating an account, you accept them, together with the Kindness Charter and the Privacy Policy.

2. The service in brief

Aparté works like a matchmaking agency: no scrolling through profiles, no chatting before the date.

  • You fill in an in-depth questionnaire. It is used to calculate your compatibility with other members.
  • Once a week, our algorithm looks for a single compatible person for each available member. You never have more than one match in progress.
  • The match is displayed with a score and three concrete reasons. A subscription is required to view the profile.
  • You have 72 hours to accept or decline. Your refusal remains confidential: the other person only learns that the match did not go ahead.
  • If you both accept, the app proposes three public venues, a theme and time slots. Each of you chooses separately, within 48 hours. The app selects the first time slot you have in common and the venue that best suits you both.
  • Before the date, each of you may ask up to 5 questions chosen from a question bank. No free-form questions, no exchange of contact details.
  • After the date, each of you says privately whether you would like to see the other again. The conversation opens only if you both wish it.

3. What we do not promise

We do our best to suggest someone who is genuinely compatible with you, but we cannot guarantee a number of matches, a date or a relationship. Our commitment is an obligation of means (best endeavours), not of result.

Matching depends on the number of members in your city. Until the city has reached a sufficient number of profiles, you remain on the waiting list, without paying anything.

4. Conditions for using Aparté

  • You must be at least 18 years old. Your age is checked at registration, using your identity document.
  • You must have your identity verified (identity document and animated selfie) by our verification provider. Without successful verification, no match is offered to you.
  • You may hold only one account, in your own name, for your personal use. The service is not intended for professional or commercial use.
  • You must be single or, at the very least, free to engage in a date in all honesty towards the person you meet.
  • You must not have previously been excluded from Aparté.

5. Your account

You register with your phone number (code received by text message) or with an Apple or Google account. You are responsible for access to your phone and your account.

Your profile information must be accurate and up to date: first name, age, recent photos (less than 2 years old) in which you are recognisable. Only your first name is displayed, never your surname, your employer or your address.

At registration, we ask for your explicit consent to use your gender and the gender you are looking for in order to suggest dates to you. Without this consent, no match can be offered to you: if you withdraw it, your profile is paused. Your area is approximate (rounded to about one kilometre).

To be put forward for a match, you must have given this consent, your profile must be verified, your questionnaire completed (at least the mandatory chapters) and at least 3 photos approved by our moderation team.

6. Pausing your profile

You can pause your profile at any time (holidays, a relationship in progress…), without losing your questionnaire. While paused, no match is offered to you. Pausing is not possible during a match in progress until the conversation has opened: first finish the match or the date.

Pausing your profile does not automatically suspend your subscription. For that, see article 9.

7. The free offer and the subscription

Free: account creation, verification, questionnaire, relationship portrait, and the "you have a match" notification (blurred profile).

Subscription, which lets you view your matches, organise your dates, ask your questions before the date and chat after a mutual yes:

Founders' offer: in each city, the first 50 verified profiles (identity verified and questionnaire completed) receive 3 months of subscription free of charge. These 3 months start on the day of their first match; no payment method is requested and no charge follows without an express subscription. One place per person, non-transferable.

You only pay from your first match onwards. The subscription is only offered to you when a match is waiting for you.

No match, no billing: if no match has been offered to you during a month of subscription, the following month is automatically free.

The subscription gives no advantage in the algorithm's ranking: it only allows you to view and organise matches.

8. Payment

You can subscribe via Apple's App Store, via Google Play or on our website (card payment through our payment provider). When you pay via Apple or Google, their terms of sale and refund procedures also apply. We never store your bank card details.

The subscription renews automatically at the end of each period, at the price then in force, unless cancelled before the renewal date. Any price change is announced to you in advance; you may then cancel free of charge.

Reminder before renewal: for the annual plan, we inform you in writing, once, between 45 and 31 days before the due date, of the renewal date and of your option not to renew, in accordance with Article L215-1 of the French Consumer Code (Code de la consommation). 9. Pausing, cancellation and free months

Pausing the subscription: you can suspend your subscription for 1, 2 or 3 months from Me › Subscription (depending on what the payment method used allows).

Cancellation: you can cancel at any time, in a few steps, from Me › Subscription, in accordance with the obligation to allow online cancellation. For a subscription taken out with Apple or Google, cancellation is carried out in the store's subscription settings, to which the app redirects you. Cancellation takes effect at the end of the current period: you keep access until then. A confirmation screen tells you that the cancellation has been recorded and when it takes effect.

Free months: a month may be given to you free of charge in three cases:

  • no match offered during a month of subscription (article 7);
  • the person you were due to meet did not show up (article 12);
  • referral (article 10).

Depending on your payment method, the free month either extends your access or takes the form of a credit applied to your next payment.

10. Referral

Each member has a referral code. An invited person may enter this code within 14 days of registering. When they take out their first paid subscription, one month is given free to the referrer and one month to the referred person. A member cannot use their own referral code.

11. Right of withdrawal

If you are a consumer, you have 14 days from subscription to withdraw, without having to give any reason.

Since your match is already available when you subscribe, you may ask to access the service immediately. In that case, before payment, we ask for your express request for immediate performance and your acknowledgement that:

  • if you withdraw within the 14 days, you will pay an amount proportionate to the service provided up to your withdrawal request;
  • [TO BE CONFIRMED: if the service has been fully performed before the end of the withdrawal period, you lose your right of withdrawal (Article L221-28, 1° of the French Consumer Code). The exact legal characterisation (provision of services or digital content) and the wording of the waiver must be validated by a legal adviser.]

To withdraw, use the withdrawal form available in Me › Subscription or write to us at [TO BE COMPLETED: email address] with an unambiguous statement. For a purchase made via Apple or Google, the refund request goes through their procedure. The refund is made no later than 14 days after your request, using the same payment method.

12. Dates, punctuality and reliability

A date involves two people. So that each can count on the other, the following rules apply.

  • Confirmation: the day before, we ask you to confirm. If both people have not confirmed 4 hours before the scheduled time, the date is cancelled. Whoever did not confirm is treated as having cancelled late; the other person is given priority in the next cycle.
  • Rescheduling: only one rescheduling is possible per date, at least 24 hours in advance. New time slots are then proposed.
  • Cancellation: you may cancel, but a cancellation less than 24 hours before counts as half a no-show. The person who was stood down is given priority in the next cycle.
  • No-show: if you have arrived (you checked in on site in the app) and the other person has not 20 minutes after the scheduled time, you can report their absence. You can also indicate it in your feedback after the date.

Reliability score: each member has a reliability score, visible only to them. It drops by 25 points per no-show and by 12.5 points per late cancellation or failure to confirm. Below 50%, no further matches are offered.

Sanctions for no-shows (a late cancellation counts as half):

Compensation: the person who travelled for nothing receives a free month and is given priority in the next matching round.

Each decision is reasoned and may be challenged (article 15).

13. Liability during dates

Aparté puts you in contact and organises the setting for the date; we are not a party to the meeting. Each person remains responsible for their own behaviour, their consumption and their safety.

We put trust measures in place: verified identity for all members, public venues only, sharing of the date with a friend or relative, an alert button, an "is everything OK?" message. These tools reduce risks but do not eliminate them. Read our safety tips before your first date.

The venues proposed are public establishments, partners as a priority. The booking is made by the app where possible; otherwise, it is up to you to check that the venue is open and available. Food and drinks are at your own expense and paid directly to the venue, which remains solely responsible for its services.

14. Rules of conduct and content

By using Aparté, you undertake to abide by the Kindness Charter. In particular, it is forbidden:

  • to post photos that do not show you, that are retouched to the point of being misleading, that are generated by artificial intelligence, or that show nudity;
  • to try to exchange contact details before the date (phone number, social media, links); our filters block them;
  • to harass, threaten, insult or discriminate;
  • to use Aparté for commercial purposes, prostitution, fraud or proselytism;
  • to create several accounts or to impersonate someone else.

You remain the owner of your photos and texts. For the lifetime of your account, you grant us a free, non-exclusive licence to host them, moderate them and show them to your match, for the sole purpose of operating the service.

15. Reporting, moderation and appeals

Reporting: you can report a profile, an answer, behaviour during a date or a message, from the app, at any time. We review reports within 24 hours, and within 1 hour for a serious report (safety, harassment). Moderation: automatic filters (contact details, nudity, hate speech) supplement human review. Every photo uploaded is checked before being shown.

Sanctions: depending on the seriousness, we may remove content, issue a warning, or suspend or exclude an account. Every decision is notified to you with its reasons and the rule concerned, in accordance with the EU Digital Services Act (DSA).

Challenging a decision: you can challenge a decision for 6 months, from Me › My data. Your challenge is reviewed by a member of the team, never by automated processing alone, and the reasoned response is notified to you. If the decision is overturned, your account is reinstated. You may also refer the matter to an out-of-court dispute settlement body certified under the DSA [TO BE COMPLETED: body chosen, where applicable] or to the competent court.

16. Closing your account

You can delete your account at any time from Me › My data. A subscription taken out on our website is then cancelled automatically. Deleting your account does not stop a subscription taken out via Apple or Google: remember to cancel it in your store.

We may close an account in the event of a serious or repeated breach of these Terms, under the conditions set out in article 15. In the event of exclusion, no refund of the current period is due, unless the decision is overturned. [TO BE CONFIRMED: no-refund clause.]

17. Availability and changes to the service

We do our best to keep the service continuously available, but interruptions may occur (maintenance, incidents). We may change the service and these Terms. Any significant change will be announced to you at least 30 days in advance; if you do not accept it, you may cancel free of charge.

18. Mediation, governing law and disputes

If you encounter a problem, please contact our customer service first: [TO BE COMPLETED: email address]. If no solution is found, you may refer the matter free of charge to the consumer mediator: [TO BE COMPLETED: name, address and website of the mediator].

These Terms are governed by French law. As a consumer, you benefit from the mandatory provisions of the law of your country of residence and may bring proceedings before the court of your choice under the conditions provided for by law.
